Terms of service

This is a product-working draft, not a final contract. Commercial and legal terms—including the contracting entity, fees, warranties, liability, termination and governing-law provisions—require formal review before production use.

1. Platform purpose

AirKo is operational software intended to help South African commercial UAS organisations manage scoped records, readiness, assets, flight requests, reviews, authorizations, reports and audit evidence.

AirKo is not affiliated with, endorsed by or approved by SACAA. It is not a regulator, does not issue regulatory approval, does not guarantee compliance and does not replace a UASOC holder’s Operations Manual, Operations Specifications, accountable personnel or regulatory responsibilities.

2. Contracting parties

The final agreement must identify the AirKo contracting entity and the customer entity, define when an individual user is bound, and identify the authorised customer representative permitted to create the tenant and accept commercial terms.

3. Accounts and authority

Users must provide accurate account information, protect their credentials and act only within assigned roles and scopes. Customer administrators are responsible for confirming user identity, assignments, authority and timely access revocation.

A role presented in AirKo records internal access. It does not, by itself, establish a person’s legal, regulatory or organisational authority outside the platform.

4. Customer responsibilities

The final agreement is expected to require customers to:

  • configure AirKo consistently with their approved documentation, authority structure and applicable requirements;
  • verify source records, expiry dates, assignments, aircraft condition, risk controls and authorization authority;
  • ensure a qualified and authorised human makes every required operational or regulatory decision;
  • obtain appropriate notices, permissions and lawful grounds for personal and operational information submitted to AirKo; and
  • maintain independent contingency procedures if the service or connectivity is unavailable.

5. Acceptable use

Users must not attempt unauthorised access, evade role or tenant controls, upload malicious material, misrepresent a record or decision, interfere with service security, use another person’s account, or use AirKo to support unlawful operations. Final enforcement, investigation and suspension procedures remain to be drafted.

6. Customer data

Ownership and permitted-use language for customer data, generated reports, audit events, feedback, aggregated telemetry and backups must be settled in the final agreement together with the approved data-processing terms. No broad licence or ownership transfer is implied by this draft.

7. Service and changes

Availability commitments, support levels, maintenance windows, change notices, beta-feature treatment, security incident procedures and business-continuity obligations must match the production service and any purchased plan. They are not promised by this draft.

8. Fees and payment

Billing is outside the first MVP. Pricing, taxes, renewal, payment, plan changes and refund terms must be expressly approved and added before any paid service is offered.

9. Warranties and liability

Warranty disclaimers, indemnities, liability exclusions and caps are deliberately omitted. These provisions materially allocate risk and must be drafted by counsel for the actual AirKo entity, service, insurance position and South African legal context.

10. Suspension and termination

The final terms must define suspension triggers, notice and remedy where appropriate, emergency security action, customer export, retention and deletion windows, audit-record handling and the effect of termination on active operations.

11. Governing terms and contact

Governing law, jurisdiction or dispute process, notice addresses, order of precedence and the AirKo contracting entity are not yet final. They must be completed and verified before these terms are presented for acceptance.
